Terms of Use

Prospect is operated by Prospect Fan, Inc., a California corporation ("Prospect," "we," "us," or "our"). These Terms of Use govern your use of prospectfan.com and its related services (together, the "Services"). Our Privacy Policy explains how we handle personal information. By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Prospect provides a platform where fans can follow athletes, purchase monthly Sponsorships and send one-time Boosts. Athletes create and control their own content and are independent of Prospect. Prospect administers checkout, subscription management, customer support and the refund policy described below. Prospect does not promise an athlete’s participation, performance or posting schedule.

Who may use Prospect

You must be able to form a binding agreement to use the Services. If you are under 18, you may use the Services only with the involvement of a parent or guardian, and athletes who are minors may participate only with verified parent or guardian approval. You are responsible for ensuring your use complies with the laws that apply to you.

The Services are not directed to children under 13. You may not create an account or use the Services if you are under 13, and we do not knowingly allow them to do so.

Your account

When you create an account, you agree to provide accurate information and keep it up to date. You are responsible for activity that happens under your account and for keeping your sign-in method secure. Tell us promptly if you believe your account has been accessed without your permission.

Prospect's role

Athletes are independent individuals, not employees, agents, or partners of Prospect, and nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship. We do not guarantee that any athlete will be accepted onto the platform, that any fan will support an athlete, or that anyone will receive a particular level of support, income, or results from using the Services.

Athlete profiles and your content

If you create an athlete profile or otherwise submit content, you keep ownership of that content. You grant Prospect a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, back up, adapt (for example, to reformat or resize it for different devices and placements), publish, display, and otherwise use that content to operate, secure, improve, and promote the Services. We may sublicense these rights to the service providers who help us run Prospect, solely so they can provide their services to us.

This license ends when you remove your content or close your account, except that we may keep and use residual copies for a reasonable period for backups, security, legal, and record-keeping purposes, and any rights you granted to others while your content was available may continue. You are responsible for the content you submit, confirm that you have the rights to share it, and confirm that it is accurate. We review profiles before they are published and may edit, decline, or remove content.

Sponsorships and Boosts

A Sponsorship is a monthly subscription to one athlete. The athlete sets a price between US $5 and US $500 per month. A Sponsorship provides personal, nontransferable access to that athlete’s available Sponsor posts during the paid subscription period. It does not include goods, prizes, personalized services or other perks, and it does not guarantee a particular number or frequency of posts. Review the athlete’s available content and price before subscribing.

Your first Sponsorship payment is charged when you subscribe. Your Sponsorship then renews automatically each month at the price shown when you subscribed until you cancel. Renewal is scheduled for the corresponding monthly billing date; if a month does not contain that date, renewal is scheduled for that month’s last day. Your subscription confirmation and Fan Dashboard show your billing and access dates. Cancel before the next renewal charge to avoid that charge.

An athlete’s later price changes apply only to new Sponsorships. The monthly price of your existing, uninterrupted Sponsorship will remain the same. If that Sponsorship ends and you later subscribe again, the price offered at that time applies.

A Boost is a voluntary, one-time support payment to an athlete of US $5 to US $1,000. A Boost does not renew and does not purchase content access, goods, services, a response or any other benefit. You may include an optional short note, subject to our content rules. Boosts are not offered as tax-deductible charitable donations.

Payment processing and cancellation

Stripe processes payments for Prospect. The amount, currency and any applicable taxes are displayed before you pay. You authorize the selected payment method for your purchase and, for a Sponsorship, the monthly renewal charges you expressly accept at checkout. If a charge fails, Stripe may retry that authorized charge; we will email you information about a scheduled retry. Receipts and payment-method updates are available through the Stripe customer portal.

To stop a Sponsorship from renewing, open your Fan Dashboard, select “Cancel at period end,” then select “Confirm cancel.” Your cancellation takes effect when confirmed: the Sponsorship will not renew, and your access continues until the end date shown for the paid period. You do not need to call us, accept an offer or use the Stripe portal to cancel. You can undo the cancellation in your Fan Dashboard before that end date if you want monthly renewal to continue at your existing price.

If you cannot or do not want to sign in, email richie@prospectfan.com to cancel. Include the email address used for your account and enough information to identify the Sponsorship. We may request information reasonably necessary to locate the subscription and verify the request. We will not require a phone call or an explanation for canceling.

Canceling a Sponsorship stops future renewals; it does not automatically refund the current paid period. Unfollowing an athlete is not cancellation. If you close your Prospect account, we will stop your Sponsorships from renewing. You can cancel without closing your account.

Refunds, disputes and payment restrictions

Sponsorship and Boost payments are generally nonrefundable, except where applicable law requires a refund or these Terms provide one. Voluntarily canceling a Sponsorship does not create a prorated refund for the current paid period; access continues through that period. We may issue additional refunds at our discretion. Contact richie@prospectfan.com about a billing error or refund request.

If an athlete leaves Prospect or we otherwise discontinue access included in your Sponsorship before the paid period ends, we will stop future renewals and either maintain that access through the paid end date or refund the portion of your payment attributable to the unused period. This remedy does not limit any additional rights you have under applicable law.

If Stripe flags a payment as suspected card fraud, we may refund it in full and end the related Sponsorship. We may restrict further payments on an account while we review suspected fraud or a payment dispute. Contact richie@prospectfan.com to request review of a payment restriction. A payment restriction does not prevent subscription cancellation or limit your legal right to dispute an unauthorized or incorrect charge.

Athlete availability and account moderation

If an athlete stops accepting Sponsorships, we will stop further renewals and notify affected Sponsors. A pause in posting does not guarantee a refund while the purchased content remains accessible. If that access ends early, the refund policy above applies. We may remove content or suspend accounts under our content rules, but those actions do not waive any refund or other consumer rights required by law.

Your permission to access Sponsor posts ends when your paid access period ends, subject to our moderation rules and the refund policy. Canceling renewal does not by itself end access before the paid period expires.

Athlete fees, payouts and taxes

Before you can receive Sponsorship or Boost payments, you must complete Stripe’s required identity and payout onboarding and accept the platform fee disclosed in your athlete account. Prospect deducts that accepted fee from covered payments and pays the ordinary card processing fees. A fan’s full payment is therefore not the amount paid out to the athlete.

Payouts are processed through Stripe, subject to successful payment, completed verification, applicable payout schedules and Stripe’s requirements. Refunds and disputes can reduce the amount available for payout. If a payment is refunded or reversed, the corresponding athlete share will be reversed or deducted from amounts otherwise payable to that athlete. Prospect does not guarantee a particular payout date or that a payment will be free of dispute.

Athletes are responsible for providing accurate tax information and for taxes on their earnings. Prospect or Stripe may make tax filings and apply withholding where required by law. Payment receipt does not establish compliance with any rule governing an athlete’s eligibility to accept it. At launch, only athletes aged 18 or older may receive paid Sponsorships or Boosts.

United States paid availability

Paid Sponsorships and Boosts are available only to residents of the United States. You must truthfully confirm your US residence and provide accurate billing information. Free following is available outside the United States where the service is offered. If we determine that you are ineligible to use a paid feature, we may restrict that feature and stop future renewal charges. Refunds will be handled under our refund policy and applicable law.

Access to Follower and Sponsor content

Some athlete content is available only to Followers or Sponsors. When you are given access to that content, Prospect grants you a personal, limited, non-exclusive, non-transferable license to view it for your own personal, non-commercial use. You may not copy, download (except where a feature expressly allows it), record, screenshot, republish, redistribute, sell, or otherwise share this content, and you may not use any automated means to scrape or collect it. Athletes keep ownership of their content. Your access to Follower content ends if your Follow ends or your account is closed. Your access to Sponsor posts ends as described under Athlete availability and account moderation above.

Acceptable use

When using the Services, you agree not to:

  • break the law or infringe anyone's rights;
  • post content that is false, misleading, harmful, harassing, hateful, or sexually explicit;
  • impersonate others or misrepresent your identity, statistics, or affiliation;
  • attempt to disrupt, probe, or gain unauthorized access to the Services or their systems; or
  • use the Services to send spam or to collect information about others without permission.

Prohibited content

You may not post, share, or link to the content below anywhere on the Services. You also may not monetize it in any way, including through Sponsorships, Boosts, Sponsor-only or Follower-only posts, or any other paid feature:

  • adult or sexually explicit content, including nudity, sexual acts, pornographic or sexually suggestive material, and adult services, whether the content is real, illustrated, or AI-generated;
  • any sexual content involving or depicting a minor, and intimate images shared without consent, as described under Child safety and intimate images below;
  • hateful content, meaning content that attacks, demeans, or promotes hatred or discrimination against people based on race, ethnicity, national origin, religion, disability, sex, gender, gender identity, sexual orientation, age, or any other protected characteristic;
  • violent content, meaning content that threatens, incites, promotes, or glorifies violence, terrorism, or violent extremism, or shows graphic violence or gore. Footage of athletes competing in contact and combat sports under the rules of the sport is not violent content; and
  • giveaways, raffles, sweepstakes, contests, prizes, or games of chance offered in connection with a Sponsorship or a Boost.

We remove content that breaks these rules. An account that posts or monetizes it may lose access to Sponsorships, Boosts, and payouts, and may be suspended or terminated.

Child safety and intimate images

Sexual content involving or depicting minors is prohibited. We promptly remove or disable access to such content. We report apparent child sexual exploitation to the National Center for Missing & Exploited Children’s CyberTipline as required by 18 U.S.C. § 2258A, as soon as reasonably possible, and securely preserve reported content and related information for the periods required by law.

Nonconsensual intimate images, including qualifying AI-generated or altered depictions, are prohibited. Our Safety and Reporting page at prospectfan.com/safety explains how anyone, including someone without a Prospect account, can report suspected child sexual exploitation or request removal of an intimate image shared without consent. We act on valid removal requests as soon as possible and within the deadlines required by applicable law. Public removal or disabling access does not prevent secure preservation when required by law.

Moderation and enforcement

We may review, moderate, remove, or restrict content, and may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk or harm. We aim to be fair, but we may act without notice when necessary.

Ending your use of Prospect

You may stop using the Services at any time and may ask us to close your account by contacting us. When your account is closed or the Services are terminated, your right to use the Services ends, but any provisions that by their nature should survive — including content licenses you have granted, disclaimers, limitations of liability, and the sections on intellectual property and governing law — will continue to apply.

Intellectual property

The Prospect name, logo, and the design, text, and other materials we provide are owned by Prospect or our licensors and are protected by intellectual-property laws. Except for content you own, these Terms do not grant you any right to use our materials without our permission.

Third-party services

Prospect uses third-party services, including Stripe for payment processing and athlete payout verification. When you use a third-party service directly, its applicable terms and privacy notices also apply. We remain responsible for the Prospect obligations described in these Terms. Our Privacy Policy explains the information we share with service providers.

Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the Services will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Prospect will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Services.

Changes to the Services and these Terms

We may change, suspend, or discontinue any part of the Services at any time. We may also update these Terms; when we make material changes, we will update the date at the top of this page and, where appropriate, provide additional notice. Continuing to use the Services after changes take effect means you accept the updated Terms.

Governing law and venue

These Terms are governed by California law and applicable federal law, without applying conflict-of-laws rules that would displace that law. Subject to any nonwaivable right to bring a claim in another forum, claims arising out of these Terms or the service may be brought in state or federal courts located in California that have jurisdiction. Nothing in these Terms limits rights or remedies that applicable law does not permit us to waive.

General

These Terms are the entire agreement between you and Prospect regarding the Services and replace any prior agreements on that subject.

  • Assignment — You may not transfer your rights or obligations under these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
  • Severability — If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver — Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Force majeure — We are not responsible for delays or failures caused by events beyond our reasonable control.
  • Notices — We may give you notices by email or by posting them within the Services; you can reach us using the contact details below.
  • Headings — Section headings are for convenience only and do not affect how these Terms are interpreted.
