Sending a copyright notice

A copyright notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed, or a representative list for multiple works; (3) identification and location of the material claimed to be infringing, with enough information for us to find it; (4) your address, telephone number and email address; (5) a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; and (6) a statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.

Sending a counter-notice

If we remove material in response to a copyright notice, its uploader may send a counter-notice containing: (1) a physical or electronic signature; (2) identification of the removed material and its location before removal; (3) a statement under penalty of perjury that the uploader has a good-faith belief that the removal resulted from mistake or misidentification; and (4) the uploader’s name, address and telephone number, a statement consenting to the jurisdiction of the Federal District Court for the district where that address is located, or, if outside the United States, any judicial district where Prospect may be found, and a statement accepting service of process from the original complaining party or its agent.

For a valid counter-notice concerning an otherwise eligible removal, we will promptly send the complaining party a copy and inform it that we will restore access in 10 business days. We will restore access between 10 and 14 business days after receiving the counter-notice unless our agent first receives notice that the complaining party has filed an action seeking a court order restraining the uploader’s alleged infringement. Material may remain unavailable for an independent legal or content-policy reason.

Repeat infringers

We maintain and reasonably implement a policy of terminating repeat infringers’ accounts in appropriate circumstances.
